Mandatory Dispute Resolution (including Arbitration, Class Action Waiver, & Jury Trial Waiver)
Mandatory Arbitration. This section outlines the resolution process for disputes related to this Agreement or the Service. You and QAZI COSMETIC CENTER agree that disputes will be resolved through final and binding bilateral arbitration or small claims court. This agreement applies to claims under the Telephone Consumer Protection Act and other applicable laws. The Federal Arbitration Act governs this agreement, and arbitration is administered by the American Arbitration Association (AAA)’s Consumer Arbitration Rules. The arbitration decision is final and binding, subject to exceptions under the FAA, and enforceable in any court of competent jurisdiction. Unless agreed otherwise in writing, arbitration follows the AAA’s Rules. YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND QAZI COSMETIC CENTER ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. THIS AGREEMENT DOES NOT ALLOW FOR CLASS ARBITRATIONS EVEN IF THE PROCEDURES OR RULES OF THE AAA WOULD. RATHER, YOU AND QAZI COSMETIC CENTER ARE ONLY ENTITLED TO PURSUE ARBITRATION ON AN INDIVIDUAL, BILATERAL BASIS. FURTHER, AND UNLESS YOU AND QAZI COSMETIC CENTER AGREE OTHERWISE IN WRITING, THE ARBITRATOR(S) MAY NOT CONSOLIDATE MORE THAN ONE INDIVIDUAL PARTY’S CLAIMS WITH ANY OTHER PARTY’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR COLLECTIVE PROCEEDING.
Changes and Updates to Terms and Conditions
Qazi Cosmetic Center reserves the right to update these SMS Terms at any time without prior notice. By remaining enrolled in any Qazi Cosmetic Center text messaging program or by providing your cell phone number for transactional, operational, or informational text messages, you agree to any revisions. Any changes will become effective immediately upon posting on the Qazi Cosmetic Center website. It is your responsibility to review these SMS Terms periodically to stay informed about any updates.
